Introduction

Please read these Terms and Conditions (“Terms”) and Privacy Policy carefully before accessing or using services provided by Psychic Soraya (“we”, “us”, “our”, “Psychic Soraya”). By booking, attending, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services — Purpose, Scope and Nature

1.1. All psychic, tarot, esoteric, channelling, and spiritual guidance services are provided for guidance, inspiration and entertainment purposes only. They are not a substitute for professional legal, medical, financial, or psychological advice. You accept full responsibility for any decisions or actions you take following a reading or session.

1.2. Any sessions offered by Soraya that combine psychic or intuitive insight with emotional healing methods such as EFT (Emotional Freedom Techniques) or other spiritual coaching practices are provided as personal and spiritual development guidance. These sessions are not intended to replace clinical psychotherapy, psychiatric treatment, or any form of regulated healthcare service. If you are experiencing a medical or mental health emergency, please contact a licensed healthcare professional or emergency services immediately.

2. Platform and Mode of Delivery (MANDATORY)

2.1. Psychic Soraya reserves the right to choose the delivery platform for one-on-one readings and consultations. At present, all one-on-one sessions (readings, coaching, or therapy-style consultations) are conducted only via WhatsApp voice calls or WhatsApp video calls. No in-person sessions or sessions via other platforms (e.g., Zoom, Skype, Face-time, telephone networks other than WhatsApp) will be provided unless explicitly agreed in writing beforehand. This policy applies to all private sessions booked through this website.

WhatsApp provides end-to-end encryption for calls and messages, but backups and certain metadata may not be encrypted unless you enable encrypted backups. Please review WhatsApp’s current Privacy Policy and Help Centre for up-to-date information.

2.2. By booking a session, you consent to being contacted via WhatsApp and for the session to be held on that platform. You are responsible for having a compatible device, a stable internet connection, and for any costs imposed by your data or mobile provider.

3. Eligibility

3.1. You must be at least 18 years old to book or receive services. By booking, you confirm that you meet this age requirement.

3.2. We do not knowingly collect information from minors. If we learn that a person under 18 has provided personal data, it will be deleted promptly.

4. Booking, Payment & Cancellation

4.1. Bookings must be made in advance using the contact and booking methods listed on our website.

4.2. Payments: All session fees are payable in advance as specified at booking, unless otherwise agreed in writing. Third-party payment processors may be used to securely process payments; we do not store full card information.

4.3. Cancellation and Rescheduling: A minimum of 24 hours’ notice is required to cancel or reschedule a booking. Cancellations with less than 24 hours’ notice may result in forfeiture of the paid fee or a cancellation charge.

4.4. Refunds: Unless otherwise required by law, all session fees are final and non-refundable. However, where local consumer protection law (for example, the South African Consumer Protection Act 68 of 2008) grants specific cancellation or refund rights, those legal rights will be honoured.

4.5. Specials and promotions:

* Readings are for personal insight and entertainment only.

* Payment in full required before booking.

* No rescheduling. Missed sessions are forfeited.

* Booked time ends when the session ends. Paid time does not extend.

* Specials are non-refundable.

* Psychic Soraya accepts no liability for how you use or interpret your reading.

*All sessions are private and confidential.

5. No Guarantees; Use of Information; Personal Responsibility

5.1. Psychic readings are interpretive and subjective. No guarantee, warranty, or assurance is provided regarding accuracy, completeness, or outcome.

5.2. By engaging in any session, you confirm that you are voluntarily participating and accept full responsibility for your own decisions, interpretations, and actions following a session.

6. Confidentiality & Privacy — Summary

6.1. Psychic Soraya is committed to protecting your privacy. We collect, store, and process personal information only as necessary to provide services and comply with legal obligations under POPIA (Protection of Personal Information Act, South Africa). For clients in the EU or UK, we also align our practices with GDPR principles where applicable.

6.2. Information collected: When you contact or book with us, we may collect your name, email address, phone/WhatsApp number, billing details, and any personal information voluntarily shared during sessions. We may also collect technical data such as your IP address, browser type, or device identifiers for analytics and security purposes.

6.3. Use of information: Personal information is used solely to deliver services, manage bookings and payments, issue confirmations/receipts, respond to inquiries, and meet regulatory or tax obligations.

6.4. Sharing: We do not sell or rent personal information to marketers. We may disclose information only to: trusted service providers (payment processors, email/hosting systems, WhatsApp/Meta); authorities where legally required; and to protect our legal rights or safety.

6.5. WhatsApp and third-party data: WhatsApp messages and calls are end-to-end encrypted, but backups and metadata may be processed by Meta. Using WhatsApp means you accept WhatsApp’s terms and privacy practices. We strongly recommend enabling WhatsApp’s encrypted backups and using phone security features.

6.6. Data retention: We keep your personal information only as long as necessary to provide services and comply with record keeping or tax laws. Retention follows POPIA and related regulations.

6.7. Your rights: You may request to access, correct, restrict, or delete your personal data, or object to certain processing. For EU/UK clients, GDPR rights (access, rectification, erasure, restriction, portability, objection) also apply. Requests can be made via the contact details in Section 15.

7. Security

7.1. We implement reasonable administrative, technical, and physical safeguards to protect personal data from unauthorised access, loss, or misuse. However, no method of transmission or storage is completely secure.

7.2. In the event of a data breach, we will promptly notify affected individuals and the Information Regulator when required by law.

8. Cookies and Tracking

8.1. This website does not use cookies for advertising or analytics. Basic technical data (such as IP address and browser type) may be automatically collected by the hosting provider for security and performance purposes only.

9. Affiliate Links & Advertising

9.1. Some blog posts or articles may contain affiliate links. These will always be disclosed. Commissions received from such links do not influence editorial content or service quality.

10. Intellectual Property

10.1. All site content — including text, logos, graphics, designs, and images — is the intellectual property of Psychic Soraya or used under license. You may not copy, reproduce, or distribute content without written permission.

11. Limitation of Liability

11.1. To the fullest extent permitted by law, Psychic Soraya will not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of income, data, or opportunities, resulting from use of our services. Liability for any direct claim is limited to the amount you paid for the session concerned.

11.2. Some jurisdictions (including South Africa under the Consumer Protection Act) do not allow certain liability exclusions. Where such laws apply, your statutory rights prevail.

12. Governing Law, Consumer Rights & Dispute Resolution

12.1. These Terms are governed by the laws of the Republic of South Africa.

12.2. Consumers are entitled to all statutory protections under the South African Consumer Protection Act and other applicable laws. Nothing in these Terms limits or excludes rights that cannot lawfully be limited.

12.3. Disputes will first be addressed directly through good-faith negotiation. If unresolved, either party may refer the matter to mediation or arbitration before approaching a court. Consumers may also contact the National Consumer Commission, DTIC, or Information Regulator (for privacy complaints).

13. Changes to Terms

13.1. We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continuing to use our services after changes take effect constitutes acceptance of the revised Terms.

14. Additional Business Policies

14.1. Minors: Services are not provided to individuals under 18. Do not submit personal data if you are a minor.

14.2. Recordings: Clients may not record sessions without prior written consent. If a recording is agreed, all parties must consent and the recording must be stored securely.

14.3. Code of Conduct: Psychic Soraya reserves the right to refuse or terminate service in cases of abusive, threatening, or unlawful behaviour.

14.4. Force Majeure: We are not responsible for delays or failures caused by circumstances beyond our control (including internet outages, strikes, pandemics, or government actions).
